The general terms and conditions of the online store tisoshop.com have been drawn up in accordance with the Consumer Protection Act (ZVPot), with the recommendations of the Chamber of Commerce and Industry and international codes for e-business.

The provider of e-commerce services, hereinafter referred to as the tenderer.

The general terms and conditions of operation deal with the operation of the online store tisoshop.com, the rights of the user and the business relationship between the provider and the buyer.

ACCESSIBILITY OF INFORMATION (SUMMARY OF LEGISLATION)

The Tenderer undertakes to always provide the buyer with the following information:

  • company identity (name and registered office, registry number),
  • contact addresses that enable fast and effective communication (e-mail)
  • essential characteristics of goods or services (including after-sales services and guarantees)
  • the availability of products (any product or service offered on the website should be accessible within a reasonable time),
  • Terms of delivery of the product or service execution (manner, place and deadline of delivery),
  • vall prices must be clearly and unambiguously determined and must be shown or already contained in taxes and transport costs
  • method of payment and delivery
  • time validity of the offer
  • a time limit within which it is still possible to withdraw from the contract and the conditions for withdrawal; moreover, if and to what extent is customer’s repayment of the product costs

The discounted code offers various benefits when it comes to purchasing and is time-limited.

Using a Promotional Code:

  • Choose the items you want to buy and place them in the basket. When you are finished adding items to the cart, continue clicking on the Cashier button. Choose a delivery method, specify the shipping address and choose a payment method.
  • In the same step, click on the payer’s details on “Do you have a coupon?” Click here to enter the code and enter the promotional code and confirm the entry by clicking on the redeem coupon button.
  • In each purchase, only one discount code can be used (for example: up to 1 promotional code can be used at the time of ordering 2 items).

ISSUING ACCOUNTS

After the delivery of the ordered items, Tiso Shop also sends the invoice to the customer in pdf format to the e-mail address of the buyer. 

The invoice contains the price and all the costs associated with the purchase.

The buyer is obliged to verify the correctness of the data before the contract is awarded. Later claims raised regarding the regularity of issued invoices are not taken into account.

PRICES

Prices are valid at the time of the award and do not have a predetermined validity. Prices apply in the case of payment with the above mentioned payment methods, subject to the above conditions. In the event that the price of the item changes during the processing of the order, the tender will inform the buyer about this. The bidder will do his best to try to provide the buyer with a lower price or in any case. to offer an appropriate solution that will go to mutual satisfaction. The sales contract between the bidder and the buyer is concluded at the moment when the bidder confirms the order (the buyer receives an electronic status message Order confirmed). From that moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.

PURCHASING PROCEDURE

  • 1. Order in queue

After the order, the customer receives a notice by e-mail that the order has been accepted in the queue. At this stage, the buyer will be able to cancel the order via e-mail within 1 hour.

  • 2. Order confirmed

After two hours of receiving the order in the queue, but not exceeding 48 hours, the tenderer shall review the order, check the availability and confirm the order or declare it for a reason. The Bidder reserves the right to call the customer, if necessary, to his contact telephone number. Upon confirmation of the order, the bidder informs the buyer by e-mail of the scheduled delivery time. The contract for the purchase of ordered items between the buyer and the tenderer is irrevocably concluded at this stage.

  • 3. Goods dispatched

In the promised period, the tenderer packs the goods, dispatches them and informs the buyer by e-mail or phone. The provider of this e-mail also informs the buyer of the return policy, how to proceed in case of delay in delivery and in the event of a complaint.

 

CONSUMER RIGHT TO CANCEL PURCHASE CONTRACT

The consumer (stated exclusively for natural persons who acquire an article for purposes outside his own gainful activity) has the right to withdraw from this contract without giving reasons. The period of expiry shall expire within 14 days of the date on which the consumer acquires physical possession on the goods or acquires it in the place of the consumer in a third party other than the carrier and designated by the consumer for that purpose.

The only cost to the consumer in respect of cancellation is the direct cost of returning goods (the buyer covers the cost of returning goods). The consumer must send back the products no later than 30 days after the notice of withdrawal. An entity may withhold payment until it receives the returned goods or until the consumer sends the evidence that the goods have been sent back, depending on which event occurs earlier.

The refund is made within 14 days of receiving a refund with the same payment method as was used in the execution of the original transaction, unless expressly agreed otherwise. In the case of a refund, the consumer will be returned to the TRR account indicated by the consumer when refunding. Refunds are not returned in cash.

The purchase contract (order) is stored electronically on the provider’s server, and the copy is automatically sent to the e-mail address of the buyer. The purchase contract is concluded in the Hungarian language.

The product you want to return should be:

  • undamaged, clean, with attached labels and unopened original packaging,
  • if the product has a safety foil it must not be broken
  • products that are sold in the original packaging must be returned in original packaging with original labels
  • When purchasing clothes, linens and bathing suits, check the size of the appropriate size by moving over the other clothes, not on the naked skin, also taking care of the leakage of makeup and powder marks.

In the event of withdrawal from the contract where the bonus, discount code or promotional code was used, these funds are considered discounted and are not returned to the user. Only the paid amount is returned to the user. The gift voucher shall be considered as a means of payment when it is canceled and returned to the user as a gift voucher and the paid amount is returned to the user.

The right to repayment of the purchase price in case of claiming the guarantee and material errors is more precisely regulated by the provisions of the Consumer Protection Act (unofficial consolidated text).

DELIVERY

The seller must deliver the goods or services in the promised time, which indirectly depends on the delivery agent. Delivery of packages is done by GLS. The scheduled delivery time is 2 to 3 business days. If you do not receive the package within 4 business days, please email it to info@tisoshop.com.

DDelivery of ordered products in our online store is carried out as soon as possible and depends on the availability of the products. We will deliver the products to the address you provided when registering or We recommend that you include the address you are in the morning. We also recommend that you write a mobile number on which you are available in the morning, as the courier will be able to call you and arrange with you about the delivery time.

In the event that you do not want to deliver the product to your address, you can also choose one of the GLS Automats and package points in which you can pick up the package yourself – you can find where they are on Hungarian GLS website.

You can pay the ransom of the package by post to the courier at delivery with cash or credit / debit card. In case of unsuccessful attempt of delivery, GLS will send you a message about the arrived package. They will call you and try to arrange the delivery three times. If they are all unsuccesful the package will be returned to our headquarters.

The ordered products will be dispatched in the same day from the order or at the latest within the delivery period, which is written for each product. We reserve the right to change the product offer and the delivery date.

GUARANTEE

Products in the online store are subject to warranty conditions in accordance with Hungarian law. The warranty is valid if the instructions for use were followed and when the invoice is shown.

MATERIAL ERROR

The consumer can claim his rights from a material error if he informs the seller of the error within two months from the day the error was discovered. The consumer must accurately describe the error in the error notification and allow the vendor to examine the item.

The seller is not liable for actual goods defects that appear after having passed two years since the thing was delivered. It is considered that the mistake of things existed at the time of extradition if it occurs within six months of the extradition.

A consumer who correctly informed the seller of an error has the right to require the seller to:

  • remove the defect on the goods or returns part of the amount paid in proportion to the defect or
  • Replace the fault goods a with new, flawless goods or
  • return the amount paid.

When is the error taken into account? When:

  • the product has no qualities that are necessary for its normal use
  • the product does not have the characteristics necessary for the particular use for which the buyer buys it, but which the seller was familiar with or should have known
  • the product has no qualities and distinctions that were expressly or silently agreed or prescribed
  • the seller has delivered an item that does not match the pattern or model, unless the sample or model was shown only for notification.

How is the suitability of the article checked?

It is checked with another, seamless article of the same type, as well as with the manufacturer’s statements or indications on the item itself.

How does buyer enforce the error?

The buyer must notify us of any material error together with the exact description of the information within the legal deadline and allow us to review the article at the same time.

The right to claim a material error on the article is more precisely regulated by the provisions of the Consumer Protection Act.

Seller must writtenly reply to the consumer request no later than eight days after its receipt, provided that the existence of an error on the goods or an irregularity in the service is controversial.

COMMUNICATION

  • clearly and unambiguously be marked as advertising messages,
  • the consignor must be clearly identified,
  • various campaigns, promotions and other marketing techniques must be designated as such; the conditions of participation in them must also be clearly defined,
  • the user’s desire not to receive promotional messages should be respected.

The user must explicitly allow the sending of e-mails and, at the request, may also ask the provider to provide him with all the information he has about him. Collected emails are used to send various campaigns and news that are up-to-date in the given time.

HOW DOES AGREEING TO PURCHASE CONTRACT OCCUR?

Select all products and their quantities that you want to order / buy and add them to the cart. Then click on the cart button (the basket opens automatically when you add the product to it) and check if these are the products you want to order. Then click the button on the cash register. In the box, enter the required information and choose a payment method. Finally, check our terms of service and privacy and agree with them and check in before ordering by clicking on the completed order button. After that, you will receive a confirmation email and you can review your data again. If at this step you notice that you want to fix anything, you must send it to the email address: info@tisoshop.com until your product is shipped.

POLICY OF PERSONAL DATA PROTECTION

The provisions in this document mainly cover the information that each seller must provide to the individual, when he obtains personal data from him. GDPR requires this information to be given in a concise, transparent, understandable and easily accessible form, and a clear and simple language. What personal data are processed:

  • Basic contact details (name, surname, telephone number, e-mail address);
  • Information about using our webpages (clicks on links, time spent), and response information to our emails (or whether the message was open to which links you clicked); 
  • Information we need to complete the contract and delivery of purchased goods (subject to purchase, price, delivery address, delivery time, payment method, date of payment, information on complaints, invoice details, etc.).

Legal basis for the processing of personal data:

We may process your personal information on the following legal bases:

  • where this is necessary to fulfill our legal obligations (eg issue invoices for purchased goods);
  • when the processing of your personal data is necessary for the conclusion and fulfillment of a contract that you have concluded with us or because you wanted us to bid;

We keep your personal data processed on the basis of your consent permanently or until you revoke this consent from your site.

We keep data on invoices issued for 10 years from the issue.

We will keep the data necessary for concluding and fulfilling the contract between you and us, for 5 years from the completion of the contract (delivery of goods).

After the expiry date, your personal information is effectively erased or anonymised, which means that we process them in such a way that they can no longer be associated with you or attributed to you.

Voluntary data transmission and consequences of directing

The provision of personal data is voluntary. You do not have to provide personal information to us, but if you do not provide them, you can not receive certain services or conclude contracts with us. What information is such that their implication results in the stated consequences, we will indicate each time we receive personal information from you.

Who has access to your personal information?

We do not provide your personal information or provide information to third parties (outside of GTM 13 d.o.o.), except for those who have a written contract with us, on the basis of which they perform certain tasks related to the processing of data and are obliged to observe the legislation regarding the processing and protection of personal data (so-called contractors). Contract processors to whom we provide personal information are:

  • You challenge the accuracy of your personal information, for a period that allows us to verify the accuracy of your personal information;
  • the processing is illegal and you are opposed to the deletion of your personal data, and instead request a restriction on their use;
  • We do not need any personal data for processing purposes, but you need them to enforce, act or defend legal claims;
  • the deletion of all personal data (the right to forget), provided that the conditions set out in the General Data Protection Regulation are fulfilled, and in particular when you revoke the consent for the processing of personal data;

If we fail to comply with the above mentioned provisions, you have the right to file a complaint against us with the Information Commissioner if you believe that the processing of your personal data violates the General Data Protection Act.

Procedure for exercising rights

You may address your requests regarding the exercise of rights in relation to personal data in writing to any contact listed at the top of this document under the Personal Data Manager and contact details.

For the purposes of reliable identification in the case of the exercise of rights in connection with personal data, we may require additional information from you and we can refuse to take action if we prove that we cannot reliably identify yourself.

At your request with which you exercise your rights in relation to personal data, we must respond without undue delay, and no later than one month after receiving your request.

RESPONSIBILITY

At its best, the provider strives to ensure the up-to-date and correctness of the data published on its website. Nevertheless, the properties of the products, their availability and price can change so quickly that the provider fails to correct the information on the web pages. In such a case, the seller will notify the buyer of the changes and allow him to cancel the order or replace the ordered item. The provider is not responsible for the contents of the opinions about the articles written by visitors. The provider is not responsible for the information in the opinions and is disconnected from any liability arising from the information in the opinions. All product photos are symbolic and do not provide product features.

COMPLAINTS AND DISPUTES

The provider respects the applicable consumer protection legislation. The seller is obliged to establish an effective complaints handling system. Within five working days, the seller will confirm that he has received the complaint and inform the buyer of the procedure for the further processing of the complaint.
